5 ) Termination
You agree that we may, at our sole discretion, suspend or terminate your access to all or part of our website and Resources with or without notice and for any reason, including, without limitation, breach of this User Agreement. Any suspected illegal, fraudulent or abusive activity may be grounds for terminating your relationship and may be referred to appropriate law enforcement authorities. Upon suspension or termination, your right to use the Resources we provide will immediately cease, and we reserve the right to remove or delete any information that you may have on file with us, including any account or login information.
6 ) Service Level Agreement
During the term of the agreement, the www.Lexproadvice.com services will be operational and available to you as a customer 90% of the time in any calendar year.
7 ) Retention and Backup
The data would be retained as backup in our systems for at least 6 months from the date of its creation. And otherwise also, we may retain such information in our systems for a limited period which may help in complying with the laws of India and also to make sure that we maintain enough backup of data which may be required to be restored in the main server for unforeseen circumstances.
8 ) Users’ Responsibilities
The users shall be liable to follow the present rules and regulations and provisions of the Indian Information Technology Act and Information Technology Rules and any other laws for the time being in force.
If the users have any grievances and discrepancies, they can address their grievances to www.Lexproadvice.com ’s Grievance Officer, whose name and address is displayed on the websites of www.Lexproadvice.com and also mentioned in the present terms. The Grievance Officer is duty-bound to redress your grievances, if any expeditiously but within one month from the date of receipt of the grievance.
Users are bound by the present Terms and Conditions for usages of the computers, computer systems, computer networks, computer resources and communication devices of lexproadvice.com.
9 ) Disputes and Jurisdiction
This Agreement shall all be governed and construed in accordance with the laws of India applicable to agreements made and to be performed in India. You agree that any legal action or proceeding between www.Lexproadvice.com and you for any purpose concerning this Agreement or the parties’ obligations hereunder shall be brought exclusively in a court of competent jurisdiction at Kolkata only. Any cause of action or claim you may have with respect to the Service must be commenced within one (1) year after the claim or cause of action arises or such claim or cause of action is barred. www.Lexproadvice.com ’s failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of this Agreement. www.Lexproadvice.com may assign its rights and duties under this Agreement to any party at any time without notice to you. In any dispute between www.Lexproadvice.com and you relating to this Site, the prevailing party will not be entitled to attorneys’ fees, costs and expenses.
10 ) Compliances with Laws:
All users shall comply with all the applicable laws (including without limitation to the Foreign Exchange Management Act, 1999 and the rules made and notifications issued there under and the Exchange Control Manual as may be issued by the Reserve Bank of India from time to time, Customs Act, Information Technology Act, 2000 as amended by the Information Technology (Amendment) Act 2008, Prevention of Money Laundering Act, 2002 and the rules made there under, Foreign Contribution Regulation Act, 1976 and the rules made there under, Income Tax Act, 1961 and the rules made there under, Export Import Policy of the Government of India) applicable to them respectively for using Payment Facility and the website
11 ) Communications:
By using this website, it is deemed that you have consented to receive calls, autodialed and/or pre-recorded message calls, and e-mails, from us at any time with the use of the telephone number and e-mail address that has been provided by you for the use of this website which is subject to the Privacy Policy. This includes contacting you through information received through other parties. The use of this website is also your consent to receive SMSs from us at any time, we deem fit. This consent to be contacted is for purposes that include and are not limited to clarification calls and marketing and promotional calls. You may also be contacted by Service Providers with whom we have entered into a contract in furtherance of our rights, duties and obligations under this document and all other policies followed by us. Such contact will be made only in pursuance of such objectives, and no other calls will be made.
The sharing of the information provided by you will be governed by the Privacy Policy and we will not give out such contact information of yours to third parties not connected with the Website. Any rights not expressly granted herein are reserved.
12 ) Geographical & Export Restrictions
You agree that all Content posted or accessible via the site is subject to applicable export control laws and regulations of the Indian Government. You agree not to export or re-export any Content directly or indirectly, to any country not permitted by Indian government export restrictions.
13 ) Payment Terms, Refund & Cancellation Policy
a ) Post cancellation of a transaction, upto 50% percent of the rendered amount will be refunded post deduction of Government money or once the experts started working in your case there is a very limited scope of cancellation as knowledge & work we provide and do business of.
b ) Against every transaction involving Government payment of any taxes or duties paid for respective transaction, such respective Challan will be generated and provided to the customer for his records.
c ) Since we’re incurring costs and dedicating time, manpower, technology resources and effort to your service or document preparation, our guarantee only covers satisfaction issues caused by Lexproadvice- not changes to your situation or your state of mind. In case you require us to hold the processing of a service, we will hold the fee paid on your account until you are ready to commence the service.
d ) Before processing any refund, we reserve the right to make a best effort to complete the service. In case you are not satisfied with the service, a cancellation fee of 50% + earned fee + fee paid to the government would be applicable. In case of change of service, the cancellation fee would not be applicable.
e ) For Assisted Plans, you can cancel your payment or request a refund before the expert assigned has commenced working on your case.
